Question about copyright for photographs of original artwork – who owns the copyright?
If I have an original piece of my artwork hanging in a show at a Gallery or a Museum and someone takes a picture of it do they have the right to offer the photograph of my artwork as public domain without asking for my permission?
I understand that I own the copyright on my original artwork, but I am not sure who owns the copyright on the photograph of my artwork – me since the photograph depicts my work, or them since they took the photograph of my work?
In the United states, if someone takes a picture of your copyrighted work, their picture is copyrighted to you… usually. In fact, it is within the rights of a copyright holder to sue the crap out of someone for taking a picture of your art, they are copying it as well as digitally transferring it.
The exception to this law is if the photograph of your work doesn’t have your art as the primary subject AND is taken so that there are other photographic elements to the picture, ie. an interesting composition.
